Mobile Application Terms of Service

This End User License Agreement (“EULA” or “Agreement”) is a legally binding agreement between you (“User,” “you,” or “your”) and Copper Stag LLC, operating as Craev (“Craev,” “we,” “us,” or “our”), governing your download, installation, and use of the Craev mobile application and the CraevControl mobile application (collectively, the “Applications”) on iOS and Android devices.

By downloading, installing, or using either Application, you agree to be bound by this Agreement. If you do not agree, do not download or use the Applications.

1. License Grant

Subject to your compliance with this Agreement, Craev grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Applications on up to two (2) personal devices that you own or control, solely for your personal, non-commercial use in accordance with this Agreement.

2. Restrictions

You may not:

(a) Copy, reproduce, distribute, or sublicense the Applications or any portion thereof;

(b) Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Applications;

(d) Use the Applications for any unlawful purpose or in violation of any applicable law or regulation;

(e) Transfer this license or your rights under this Agreement to any third party;

(f) Use the Applications to list, sell, or facilitate the sale of alcohol or alcoholic beverages.

3. Account Requirements

Use of the Applications requires account registration. You must be at least eighteen (18) years of age. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Email verification is required before accessing Platform features.

4. Device Permissions

4.1 Location

The Applications request access to precise GPS location data. Vendor devices use location to broadcast truck position to nearby customers. Customer devices use location to display nearby trucks. Location permission is required for core Platform functionality. You may revoke location permission at any time in your device settings, which may limit Platform features.

4.2 Push Notifications

The Applications request permission to send push notifications, including order status updates, followed truck alerts, and promotional messages. You may manage notification preferences in the app settings or your device settings.

5. In-App Purchases and Subscriptions

The Craev consumer application processes food orders via Stripe, Inc. The CraevControl application offers monthly subscription plans billed via Stripe. Subscription pricing and features are described within the Application. Subscriptions are month-to-month and may be cancelled at any time through the app settings. Fees are non-refundable except where required by applicable law.

6. Intellectual Property

The Applications and all content, features, and functionality therein are the exclusive property of Copper Stag LLC, protected by applicable intellectual property laws. This Agreement does not convey to you any ownership interest in the Applications.

7. Third-Party Services

The Applications integrate with the following third-party services:

(a) Stripe, Inc. — payment processing;

(b) Google LLC — mapping and location services.

Use of these third-party services is subject to their respective terms of service and privacy policies. Craev is not responsible for the practices of third-party service providers.

8. Disclaimer of Warranties

THE APPLICATIONS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CRAEV DOES NOT WARRANT THAT THE APPLICATIONS WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CRAEV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APPLICATIONS. CRAEV'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO CRAEV IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. App Store Terms

10.1 Apple App Store

If you download the Application from the Apple App Store, you acknowledge that: (a) this Agreement is between you and Craev only, not Apple Inc.; (b) Apple has no obligation to provide support or maintenance for the Application; (c) Apple is not responsible for any claims relating to the Application; (d) Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.

10.2 Google Play Store

If you download the Application from the Google Play Store, your use is also subject to Google Play's Terms of Service.

11. Termination

This Agreement is effective until terminated. Craev may terminate this Agreement and your license immediately if you breach any provision of this Agreement. Upon termination, you must cease all use of the Applications and delete all copies from your devices.

12. Governing Law

This Agreement shall be governed by the laws of the State of North Carolina without regard to its conflict of law provisions.
